Terms of Service

Effective date: 17 September 2026

These Terms form a binding agreement between you and Mobivatar Interactive Technologies Private Limited (“Mobivatar”, “we”, “us”), a company incorporated in India with its registered office at 116, Vyasar Street, Kamakshi Nagar, Valasaravakkam, Chennai – 600087, Tamil Nadu, India.

By downloading, accessing or playing Foodogeki, you accept these Terms. If you do not accept them, do not use the Game.

1. Eligibility

You must be at least 18 years old, or older where your local law requires. If you are under 18 and in India, a parent or lawful guardian must give verifiable consent before you may hold an account. If you are under the age of majority anywhere, you confirm a parent or guardian has read and accepted these Terms on your behalf.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play Foodogeki for your own non-commercial entertainment. All rights not expressly granted are reserved.

3. Your account

You are responsible for activity on your account and for keeping your login credentials secure. Accounts are personal to you. You may not sell, rent, gift, trade or transfer an account, and you may not buy or accept one from anyone else.

You may delete your account at any time from the in-Game Settings screen.

4. Virtual items and in-game currency

Foodogeki offers optional purchases of cosmetic virtual items and in-game currency (collectively, “Virtual Items”).

• Virtual Items have no monetary value and cannot be redeemed, exchanged or cashed out for money or anything of monetary value, inside or outside the Game.
• You receive a limited licence to use Virtual Items within Foodogeki. You do not own them.
• Virtual Items cannot be transferred between accounts or traded with other players.
• We may change, rebalance, reprice, substitute or discontinue any Virtual Item. This may affect items you already hold.
• Any unused Virtual Items are forfeited if your account is closed by you or terminated by us for breach of these Terms.
• Foodogeki does not involve wagering, staking, betting or any opportunity to win money or anything of monetary value. It is a cosmetic-only, no-cash-out game.

5. Purchases and refunds

All purchases are processed by Apple or Google under their own terms. Refunds are handled by the platform from which you purchased. Our Refund Policy at https://foodogeki.com/legal/refunds explains how to request one and the limited circumstances in which we can assist directly.

Prices include applicable taxes where required. Prices may change at any time.

6. Advertising

Foodogeki is free to play and is supported in part by advertising. The Game displays advertising supplied by Google AdMob and, where mediation is enabled, by third-party advertising networks available through that platform. Advertising may appear between matches, in rewarded placements you choose to engage with, and in other placements within the Game.

We may change the format, frequency and placement of advertising at any time. Opting out of personalised advertising changes the relevance of the ads you see; it does not remove advertising from the Game.

7. Player conduct

Foodogeki includes real-time multiplayer and chat. You agree not to:

• Harass, threaten, abuse or discriminate against other players
• Post sexual content, hate speech, or content harmful to minors
• Cheat, exploit bugs, use bots, modified clients, automation or third-party tools that affect gameplay
• Match-fix, boost, smurf for the purpose of unfair matchmaking, or manipulate leaderboards
• Buy, sell or advertise accounts, Virtual Items or services for real money
• Impersonate Mobivatar staff or other players
• Reverse engineer, decompile, scrape, or interfere with the Game or its servers

8. Moderation and enforcement

We may issue warnings, mute chat, remove content, roll back progress, suspend or permanently terminate accounts for breach of these Terms. Where we take action against your account we will tell you the reason, and you may appeal to support@foodogeki.com within 30 days.

9. User-generated content

You retain ownership of content you create, such as chat messages, clan names and custom text. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and distribute that content for the purpose of operating and promoting the Game. You confirm you have the rights to any content you submit.

10. Our intellectual property

Foodogeki, the Mobivatar name and logo, and all art, characters, audio, code and design are owned by Mobivatar or our licensors. Fan creations are addressed in our Fan Content Policy at https://foodogeki.com/legal/fan-content, which permits non-commercial use subject to the conditions stated there.

11. Service availability and changes

We aim to keep Foodogeki available but do not guarantee uninterrupted service. We may update, modify, suspend or discontinue features, and may rebalance gameplay at any time. If we discontinue the Game entirely, we will give at least 90 days’ notice and stop selling Virtual Items from the date of that notice.

12. Disclaimers and liability

The Game is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Subject to that, our total aggregate liability to you is limited to the lesser of the amount you paid us in the three months before the claim arose, or INR 5,000.

13. Termination

You may stop using the Game and delete your account at any time. We may suspend or terminate your access for breach of these Terms, for legal reasons, or if we discontinue the Game. Sections 4, 9, 10, 12 and 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of India. The courts at Chennai, Tamil Nadu have exclusive jurisdiction.

Before commencing proceedings, please raise the matter with our Grievance Officer at grievance@foodogeki.com so we have a chance to resolve it.

15. Changes to these Terms

We may amend these Terms. Material changes will be notified in the Game or by email at least 15 days before they take effect. Continued play after that date means you accept the amended Terms.
